Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ZenDepth iOS application ("App") operated by ZenDepth ("we", "us", or "our").
By downloading or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years of age to use ZenDepth. By using the App, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent.
2. Safety Disclaimer
Breath-hold training carries serious risks, including loss of consciousness and death.
You must follow these safety rules at all times:
- Dry land only. Never practice breath-hold training in water without a qualified safety diver present.
- Never train alone. Always have a trained buddy or safety diver present, even for dry land sessions.
- Listen to your body. Stop immediately if you experience dizziness, chest pain, tingling, or any unusual sensation.
ZenDepth is a training aid and does not replace proper freediving instruction or medical advice. Consult a physician before beginning any breath-hold training programme.
By using the App, you acknowledge and accept these risks and agree that ZenDepth is not liable for any injury, illness, or death resulting from your use of the App or participation in breath-hold activities.
3. Account
You may use ZenDepth anonymously or sign in with Apple or Google. You are responsible for maintaining the security of your account. You agree to notify us immediately of any unauthorised access.
We reserve the right to terminate accounts that violate these Terms.
4. Free Phase and Premium Access
Phase 1 is free. You may complete the full 12-session Phase 1 training programme at no cost, with no time limit and no credit card required.
Access to Phase 2 and all subsequent phases requires an active Premium subscription or a one-time Lifetime purchase. After Phase 1, you will be invited to subscribe before continuing your guided training.
There is no separate free trial period — Phase 1 is the free experience.
5. Subscriptions and Purchases
ZenDepth offers the following In-App Purchases, processed exclusively through Apple's App Store:
- Monthly ($3.99/month) — Auto-renewable subscription
- Yearly ($19.99/year) — Auto-renewable subscription
- Lifetime ($49.99, one-time) — Non-consumable, permanent access
Auto-Renewal
Monthly and Yearly subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation
You may cancel your subscription at any time through your iPhone Settings → [your name] → Subscriptions → ZenDepth. Cancellation takes effect at the end of the current billing period — you retain access until then.
After cancellation, your training progress is preserved. You retain full access to all Manual Drills (Static Apnea, CO₂ Table, O₂ Table, Stretching) indefinitely, even without a subscription.
Refunds
All purchases are processed by Apple. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We do not process refunds directly.
Price Changes
We reserve the right to change subscription pricing. You will be notified of any price changes before they take effect and will have the opportunity to cancel.
6. Intellectual Property
The App, including all content, training programmes, design, graphics, and underlying software, is owned by ZenDepth and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
Your training data remains yours. We do not claim ownership of data you generate through your use of the App.
7. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorised access to any portion of the App or its infrastructure
- Interfere with or disrupt the integrity or performance of the App
- Reverse-engineer, decompile, or disassemble the App
- Use automated means (bots, scrapers) to access or interact with the App
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or meet your specific requirements.
Training programmes are generated algorithmically based on your personal best data. They are not medical advice and are not designed or supervised by licensed medical professionals.
9. Limitation of Liability
To the maximum extent permitted by applicable law, ZenDepth shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or death, arising from your use of or inability to use the App.
Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid to us in the twelve months preceding the claim.
10. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
11. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by in-app notification. Continued use of the App after changes take effect constitutes your acceptance.
